These terms apply to your use of novafx-lab.com and to services provided by Nova FX Lab, a brand of Aarkayaa Exports Private Limited (“we”, “us”). By using the website or engaging our services, you agree to them.
1. Services
The scope, deliverables, timelines and fees for any engagement are set out in a written proposal or agreement. If that document conflicts with these terms, the proposal or agreement applies.
2. Your responsibilities
You agree to provide accurate information, timely approvals and the account access we need. You are responsible for paying advertising spend and third-party tools (such as Zoho One, WhatsApp API or hosting add-ons) directly unless agreed otherwise.
3. Fees and payment
Fees are payable as stated in your proposal. Late payment may pause work. Applicable taxes are added where required.
4. Results
Marketing results depend on many factors outside our control, including platforms, competition and market conditions. We do not guarantee specific rankings, AI recommendations, leads or sales.
5. Ownership
Once paid for in full, final creative and content made for you belong to you. Domains, ad accounts, CRM and other accounts are kept in your name. We may keep our own tools, templates and know-how, and may show non-confidential work in our portfolio unless you ask us not to.
6. Confidentiality
Each party will keep the other’s confidential information private and use it only for the engagement.
7. Website use
You may not misuse the website, attempt to disrupt it or copy its content for commercial use without permission.
8. Limitation of liability
To the extent allowed by law, our total liability for any claim is limited to the fees you paid us in the three months before the claim. We are not liable for indirect or consequential losses.
9. Termination
Termination terms are set out in your agreement. See also our Refund & Cancellation Policy.
10. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Mahoba, Uttar Pradesh, where our registered office is located, have exclusive jurisdiction.
